General provisions
These conditions of sale are applicable to all contracts concluded between, on the one hand, BYSIX whose head office of exploitation is located at YPRES Belgium, registered with the Carrefour Bank of Companies under the number 0713.773.609 hereinafter called " the seller "and, on the other hand, any person wishing to make a purchase via the seller's website, hereinafter referred to as" the buyer ".

We mean by :
Buyer : any natural person having reached the age of majority and having full legal capacity or, failing this, the legal representative of this person. In the latter case, the legal representative is required to comply with these general conditions.
Consumer : any natural person who acquires or uses for purposes excluding any professional or commercial nature of the products placed on the market.
Professional buyer : any natural or legal person not falling within the definition of consumer given in the preceding paragraph.
1. Object
These conditions of sale are used to define the contractual relations between the seller and the buyer as well as the conditions applicable to any purchase made through the seller's website.
By accepting the order confirmation via our website, the buyer expressly acknowledges having read these general conditions, having understood them and having accepted them, it being understood that any order of a product via our website implies consultation and express acceptance of the general conditions of sale. These general conditions of sale can be saved or printed by the customer.
The provisions which are not expressly derogated from remain applicable. Only the exceptions that are the subject of a written agreement on our part can modify the application of these general conditions. The seller nevertheless reserves the right to modify these general conditions at any time. The conditions applicable to the order are those in force at the time of confirmation thereof.
In the event of conflict between the general conditions of our contracting partners and ours, it is agreed that only the latter will prevail.
2. Products
Unless otherwise stipulated and written, the products we offer on our website are those which appear there on the day of the order, within the limits of available stocks.
3. Orders
Any order sent to us is only binding upon written confirmation from us by email. The modifications made by the customer to his order form or to our offer will only be valid on condition that we have accepted and confirmed them in writing. In the event of unilateral cancellation of an order by the customer acting for professional purposes, we reserve the right to demand compensation equal to 30% of the total amount of the order. In the event of cancellation of an order by the customer for a personalized product after 48 hours of validation, we reserve the right to demand compensation equal to 50%.
3.1 Color ring
The buyer has the possibility of renting or purchasing our complete color ring, in order to determine the shade that corresponds to him.
In the case of rental :
The color ring is invoiced at €10 excluding delivery costs. However, a deposit of €93 will be paid.
The consumer has a period of 48 hours upon receipt of the product to return it via the competent postal services, imperatively with insurance included.
The deposit of €93 will be refunded upon receipt of the product by the seller.
The refund will be made on the buyer's payment method used when ordering.
In the case of purchase :
The color ring is invoiced €103 excluding delivery costs.
4. Orders confirmation
After validation of the order and once the payment has been made, the consumer receives by email an order confirmation and a summary, including all the validated products. Our service will then take care of the creation of the hair within 48 hours, if it is requested custom-made or in stock.
In order to place an order validly, the buyer must:
- Fill in the identification form or give his customer number if he has one;
- Fill in the online order form giving all the references of the products or services chosen;
- Confirm your order after checking it;
- Acknowledge having read these general conditions and having accepted them;
- Make the payment under the conditions provided;
- Confirm the order and the payment.
The sale is perfect when the buyer confirms the order.
BYSIX reserves the right to cancel an order at any time. The buyer will be notified in advance and refund will take place on the payment method used during the purchase.
No shipment will be made without order confirmation and receipt of full payment thereof.
Products and services are offered while stocks last. If an item is unavailable, the seller will inform the buyer by email as soon as possible. The latter will have the option of choosing between waiting (in the event of temporary unavailability) or canceling the order of unavailable items free of charge.
5. Times
The deadlines set for our personalized products are between 5 and 7 weeks (at least with the "express" option for shipping) or 8 and 10 weeks (for standard shipping). For hair supplements "in stock" the shipping time announced by our services is 7 working days, plus the delivery time according to the postal services.
All our hair supplements are created by hand by our technicians, so we ask our users to be tolerant in case of delay. Deadlines may be delayed by a few days / weeks without compensation.
For the confection of a hair complement according to a size template, the manufacturing begins once the mold is received and sent to our technicians. It therefore generally takes an additional week to the announced deadlines. All tailor-made confections are validated after 48 hours to allow possible modifications before manufacturing.
In the case of specific options (longer hair length, density greater than 110%, base size greater than 20 x 25 cm, custom color, etc.), a delay may be noted by several days / weeks.
For a payment by bank transfer, the making of personalized hair (or the sending of a capillary complement of the stock) will start only once the sum received by our bank.
Even in this case, the following circumstances free us from our deadlines :

Force majeure (including, in particular, strikes, technical incidents, flooding, fire, shortage of product from our supplier, computer virus, etc.);

If the order to start our services is given late in relation to the contract to our order confirmation;

If the payment conditions are not respected;
-
If the customer does not provide us with the information necessary to process their order.

If the customer places his order during the leave period of our technicians.
5.1 Legal vacation periods
- From February 1 to 10.
- From October 1st to 7th.
- From January 24th to 31st.
6. Deliveries and transport
The delivery of the Product(s) ordered takes place at the address mentioned by the customer when ordering. We cannot be held responsible in the event of non-delivery/delay of postal services or to an incorrect address if this is the one mentioned by the customer.
In the event of sale to a professional, transport is done at the risk of the buyer. Upon delivery of the item, the buyer checks whether the products ordered match. In the event of an item missing, damaged or not corresponding to the order placed, the buyer is invited to contact customer service by telephone or by email at [email protected]
In the event that your order arrives damaged due to transport, BYSIX will not be held responsible and will not be obliged to make the refund.
For customers resident abroad (outside France and Belgium), customs fees may be charged to your order at the time of delivery. BYSIX cannot be held responsible for these costs and must in no case refund.
7. Retraction
In accordance with the law, the consumer can notify the seller that he renounces his purchase, without penalty and without giving any reason, within 14 calendar days from the day after the day of delivery of the item. This right of cancellation does not belong to the professional buyer.
"Personalized" products are neither exchangeable nor refundable, as are products and accessories. Within this period, the consumer must notify his decision to withdraw by means of an unambiguous declaration either by email; or by post to the address of our office as mentioned above. In case of withdrawal, the seller will refund all payments received from the buyer, including delivery costs and without undue delay.
The return costs are borne by the buyer and the items travel at his own risk. The order must be returned in its original packaging, accompanied by all its accessories, the user manual and must not have been subject to any degradation (modification of the waviness, humidification, coloring, or any other manipulation preventing the item from being returned to stock). The seller reserves the right to only make a partial refund if it turns out that the returned item is damaged, incomplete or damaged.
TO KNOW: the lifetimes mentioned on the site are indicative and depend on each user and his daily life. This type of product being considered as "perishable", the BYSIX company cannot compensate the customer if it finds a lifespan lower than that communicated on the site.
If the customer is not satisfied with the work carried out by himself or the professional, he cannot in any case question the quality of the product bought in our shop and cannot ask for the refund of his product.

7.1 BYSIX training
The buyer who places the order is recognized as responsible for the reservation and payment thereof, even if the order is placed on behalf of one or more third parties. Personal companions are not admitted.
The reservation may be partially refund (50%) up to one week before the training date. No refund possible after this period.
If the event is canceled, you will be offered a full refund of the sale price of the reservation.
BYSIX prohibits the resale of private reservations at a price higher than that mentioned on the site.
Training accessible only to hairdressing professionals.
8. Prices
The fixed prices are given in euros, inclusive of all taxes.
Our prices are in principle not subject to revision, but we may, however, make a price change or pass on to them changes in the rate of VAT occurring before the delivery date.
BYSIX also reserves the right, at any time, to modify the prices. However, the prices applicable to the order are those in force at the time of placing it.
8.1 Loyalty program
Promotional codes can only be used once per person. Reduction codes (loyalty points) can be deactivated by us at any time for any reason without incurring our liability. We limit the challenges within the limits of the reasonable. BYSIX may deactivate customer balances without notifying users. For more information, our team is available to answer your questions. When a customer uses his balance to convert it into euros and it is used for an order, then the customer does not accumulate points for this new purchase.
9. Payment
We provide the customer with the following payment methods:
- By credit card (VISA, MasterCard, American Express) via our completely secure payment platform.
- Via PayPal (secure server), which supports card payments, without necessarily needing a PayPal account.
- By bank transfer. Each order paid by this means of payment will be taken into account only upon receipt of the initial amount of the order. The transfer must be made to the account indicated during the validation of the order. Any costs related to the payment of the sum will be borne by the customer and should not be deducted from the initial amount corresponding to the order.
The BYSIX brand does not support payment in installments. In the event that the customer makes a transfer of different sums several days apart, the payment will be returned to him and the order will not be dispatched.
The secure credit card payment server can detect suspected fraud. The BYSIX team may have to ask you for personal identity and domiciliation information by email and/or phone in order to prove your identity and raise the suspicion of fraud. This procedure is valid for card payments via the secure "MOLLIE" or "PAYPAL" server.
These requests for information are sent from BYSIX's email address. In case of non-response, the order will be canceled and the amount refunded on the initial payment method.
10. Guarantee in case of sale - Buyer acting for non-professional purposes
The purchaser acting for private purposes benefits from the legal rights under the law of September 1, 2004 relating to the protection of the consumers in case of sale of consumer articles. In accordance with article 1649quater §2 of the Civil Code, the consumer is required to inform the seller of the existence of a lack of conformity within two months from the day on which the consumer has noted the defect. This warranty only covers defects of conformity existing at the time of delivery of the products. Defects or damage due to improper use, such as water damage, oxidation, fall or shock, neglect and wear, are not covered by the warranty. Likewise, repairs carried out by technicians not approved by our services, will give rise to the cancellation of the warranty.
The invoice or delivery note acts as a guarantee and must be kept by the consumer and produced in original.
11. Protection of privacy - Data processing
The personal data communicated by the customer are strictly confidential. We undertake to use them only in the context of the processing and proper execution of the customer's order and to authorize access to this information only to staff members who must read it for the proper management of orders.

12. After sales service
The customer can request the exchange of his product "in stock" within 7 days from the date of receipt, in case of error on the choice of color or product itself. It will be necessary to contact us before by email or phone, in order to proceed with the exchange if we believe that the client is eligible.
Return costs are the responsibility of the customer and the latter may in no case request a refund. Only one exchange per order is possible.
If the customer is not satisfied with the fixing made by himself or the professional, he cannot in any case question the quality of the product bought in our shop and cannot ask for the refund of his product.
"Personalized" products with a percentage of gray are not exchangeable.

13. Responsibilities
The seller, in the online sales process, is only bound by an obligation of means; it cannot be held liable for damage resulting from the use of the Internet and online payment such as loss of data, intrusion, virus, break in service, or other involuntary problems.
The data on the site are communicated in good faith. The links offered to the websites of manufacturers and / or partners are given for informational purposes and have no contractual value. The seller cannot be held responsible for information from these sites.
The buyer is responsible for the choice and use of the product delivered by the seller. He certifies that he is 18 years of age when ordering. The seller declines all responsibility in the event of inaccuracy of the information communicated to him by the buyer.
IMPORTANT : It's recommended for all people to do an allergic test before the application of fixing, maintenance or care products. BYSIX cannot be held responsible for any reaction or problems related to the use of the products.
14. Intellectual property
All elements of the seller's site are and remain the intellectual and exclusive property of it. No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or audio. Any simple link or hypertext is strictly prohibited without prior written agreement from the seller.
15. Proof
The parties accept electronic means of proof (for example: email, computer backups, etc.).
16. Disputes
These online sales conditions are subject to Belgian law. In the event of a dispute, the courts of the seller's registered office are competent, unless there are binding legal provisions to the contrary. Information on alternative dispute resolution methods can be obtained. We nevertheless reserve the right to submit any possible dispute exclusively to the courts.
17. Changes to the Agreement
Any change to the specific agreements or general conditions present must be the subject of a written amendment signed by all parties.
18. Saving clause
The invalidity, non-applicability or illegality of one of the clauses provided for in one of the contracts agreed between the parties (specific and general conditions or other agreements) does not in any way result in the invalidity or nullity of the other provisions to the contract. All of the clauses remain fully valid.
